Terms and Conditions of Sale and Use

Welcome to Lab Peptides France. 9 short articles covering sales, shipping, returns and liability — read them before you order.

Article 1: Preamble and Identity

These Terms and Conditions of Sale and Use (hereinafter the "Terms") exclusively govern the contractual relationship between Atlas Lab Solutions LLC, registered in New Mexico (USA), with its registered office at 1209 Mountain Road PL NE, Albuquerque, NM 87110 (hereinafter the "Seller") and any person visiting or making a purchase on the website.

By validating their order, the Buyer declares they have the legal capacity to contract and accept these terms without reservation.

The site is open to consumers and professionals alike (researchers, laboratories, academic institutions, businesses). A consumer is any natural person acting for purposes outside their trade, business, craft, profession or farming activity: they enjoy all the rights granted to them by the French Consumer Code, in particular the right of withdrawal (Article 6) and the legal guarantees (Articles 6 and 7). A Buyer ordering for the purposes of their professional activity is a professional: the right of withdrawal is not available to them, except in the cases provided for in Article L221-3 of the French Consumer Code, and the provisions specific to professionals, identified as such, apply to them.

Article 2: "Research Use Only" (RUO) Warning

WARNING: All products sold on this website are chemical compounds intended exclusively for laboratory research and in vitro analysis.

They are NOT medications, food products, cosmetics, or medical devices.

They are strictly prohibited for any human use (injection, ingestion, topical application) or veterinary use.

The Buyer, whether a consumer or a professional, acknowledges having the knowledge and equipment necessary to handle these products safely.

The Seller reserves the right to cancel any order if there is reason to believe the products will be used for non-compliant purposes (personal use, doping, self-medication).

Article 3: Product Characteristics

Products are described (technical sheet, purity, sequence). However, photos are not contractual.

The indicated purity (e.g., ≥98%) is the specification of the reference. Available Certificates of Analysis (COA) are published on the relevant product pages.

Peptides are delivered in lyophilized form (powder) and must be stored according to technical recommendations (freezing) upon receipt.

Article 4: Price and Payment Terms

Prices are displayed in Euros (€) including all taxes (incl. VAT) for the European Union.

The Seller reserves the right to modify prices at any time, but the product will be invoiced based on the rate in effect at the time of order validation.

Payment is due immediately upon order by credit card. No shipment will be made before full receipt of funds.

Article 5: Delivery and Risks

Products ship from our stock in France, within the European Union.

Orders ship Monday to Saturday: an order placed before 6 pm (Paris time) is dispatched on the next working day, public holidays excepted. Transit then takes 2 to 5 working days within France depending on the method chosen, longer abroad. These transit times are indicative; in any event, the Seller undertakes to deliver no later than 30 days after the order.

For a consumer, the risk of loss of or damage to the products passes to them when they, or a third party they have designated, take physical possession of the parcel (Article L216-4 of the French Consumer Code). In case of loss confirmed by the carrier, the Seller reships the order at its own expense.

The Buyer is responsible for verifying the legality of imported products in their country of residence.

Article 6: Right of Withdrawal, Returns and Refunds

You have 14 days from receipt of your order to exercise your right of withdrawal, without having to give any reason (Articles L221-18 et seq. of the French Consumer Code). To exercise it, send us an unequivocal statement before this period expires, by email to contact@lab-peptides-france.com, quoting your order number. You may use the model withdrawal form reproduced in the appendix to these terms, but you are not obliged to.

Legal exception: under Article L221-28 of the French Consumer Code, the right of withdrawal cannot be exercised for products unsealed after delivery that cannot be returned for reasons of hygiene or health protection. A vial whose cap or seal has been removed, pierced or broken can therefore be neither taken back nor refunded. Returned products must be complete, sealed and in their original packaging.

Return costs: they are borne by you, unless the return results from an error on our part (non-conforming product, picking error, item damaged on arrival), in which case they are borne entirely by the Seller. For a return from France, we send you a prepaid Mondial Relay label to drop off at a relay point; in case of withdrawal, its cost, stated with the label, is deducted from the refund. From another country, write to us before sending anything: we will tell you how to return the products.

Refund: in case of withdrawal, the Seller refunds all sums paid, including the initial delivery costs (on the basis of the cheapest standard delivery method offered), no later than 14 days after being informed of your decision; it may withhold the refund until it has received the products back or until you have supplied proof of having sent them. The refund is made to the bank card used for the order, the only payment method accepted; it appears on your statement within a few business days, depending on your bank's usual processing time.

If an item is missing or damaged on receipt, report it to us by email, preferably within 7 days of delivery. Atlas Lab Solutions LLC will, at the customer's choice and at its own expense, either reship the affected item or issue a refund for the corresponding amount. These two resolution methods are mutually exclusive: the customer cannot receive both a reshipment and a refund for the same item. This article does not deprive the consumer of the legal guarantee of conformity (Articles L217-3 et seq. of the French Consumer Code) or of the guarantee against hidden defects (Articles 1641 et seq. of the French Civil Code).

Article 7: Limitation of Liability

The Seller is liable as of right to the consumer Buyer for the proper performance of the obligations arising from the contract (Article L221-15 of the French Consumer Code). It may be released from this liability, in whole or in part, only by proving that the non-performance or improper performance is attributable either to the Buyer, or to the unforeseeable and insurmountable act of a third party unconnected with the supply of the services provided for in the contract, or to force majeure. The Seller is not liable for damage resulting from use of the products contrary to their intended purpose (Article 2) or to the storage conditions indicated (Article 3), unless it is at fault.

Nothing in these terms limits or excludes the legal guarantee of conformity (Articles L217-3 et seq. of the French Consumer Code), the guarantee against hidden defects (Articles 1641 et seq. of the French Civil Code), liability for defective products (Articles 1245 et seq. of the French Civil Code), or the Seller's liability for its own fault or for personal injury.

Professional Buyer: where the Buyer orders for the purposes of their professional activity, and to the extent permitted by law, the Seller's liability in respect of an order is limited to the amount of that order and does not cover indirect damage, such as loss of business or turnover. This limitation does not apply in the event of gross negligence or wilful misconduct, nor to personal injury.

Article 8: Data Confidentiality

We place paramount importance on the confidentiality of your data. Your personal information is only used for processing your order.

In accordance with our privacy policy, we minimize data retention. Sensitive information related to orders is regularly purged from our connected servers.

No data is sold to third parties.

Article 9: Applicable Law and Jurisdiction

These terms are subject to the law of the State of New Mexico (USA), the company's registered office.

However, this choice of law cannot deprive a consumer residing in the European Union of the protection afforded to them by the mandatory provisions of the law of their country of residence.

In case of dispute, the Buyer is invited to write to customer service by email first, in order to seek an amicable solution. This step is not a mandatory prerequisite for the consumer, who retains the right to bring the matter before the competent court, in particular that of their place of residence.

Appendix: model withdrawal form

Model form provided for in the appendix to Article R221-1 of the French Consumer Code. Its use is optional: any unequivocal statement is sufficient (Article 6). The simplest way is to copy it into an email sent to contact@lab-peptides-france.com.
